    Matt Ochs, Partner at Holland Hart, maintains national real estate and bankruptcy practices involving financing, real property matters, legal opinions, complex chapter 11 cases, loan workouts, and receiverships.

    Real Estate & Opinions: Matt has a diverse real estate practice ranging commercial construction and term loan financing to real property interests of renewable energy clients with assets in the Mountain West and across the United States. He structures, negotiates, and closes deals for financial institutions, private lenders and equity funds, and borrowers. He advises clients on all aspects of real estate financing transactions, including lending and borrowing using construction, term, non-recourse term, revolving credit, and syndicated and single lender loans in single asset and multi-state/multi-asset real estate transactions. He regularly provides debt financing and substantive non-consolidation opinions in real estate and commercial lending transactions. He also supports the firm’s energy and infrastructure teams on a wide-range of real property issues and opinion requirements, with an emphasis on wind, solar, and other energy projects.

    Bankruptcy & Insolvency: Matt provides business-focused bankruptcy and insolvency advice to business partners, trade creditors, investors, lenders, and other secured and unsecured creditors, ranging from day-to-day counsel, transactional drafting, and actively participating in complex bankruptcy cases and proceedings. He emphasizes oil & gas, mining, renewable energy, real estate, and corporate clients, and has developed a national profile from his work on cases filed across the United States, including in Delaware, New York, Texas, Colorado, Nevada, and New Mexico. He clerked on the U.S. Bankruptcy Courts for the Districts of Colorado and Utah, and on the Colorado Court of Appeals. He also serves as Co-Chair of the ABA’s Subcommittee on Business Bankruptcy Transactions.

    Loan Workouts & Receivership: Matt leverages his real estate and bankruptcy experience to effectively lead clients through workouts of non-performing loans and distressed residential, commercial, and mixed-use projects. He negotiates and prepares loan modifications and forbearance agreements. He also seeks the appointment of receivers on behalf of lenders and has experience with foreclosure related litigation. In addition, he assists loan servicers in various loan servicing matters.

    In-House Experience: Matt was formerly in-house counsel with a multinational software services company, emphasizing corporate matters, contracts, licensing, and real estate leasing in the U.S. and Europe.
