Michael concentrates his practice on environmental transactional matters, regulatory counseling, and environmental litigation. He handles a wide range of environmental matters, including brownfield redevelopment projects, transactional-related environmental due diligence, multi-party state and federal litigation involving cost recovery, injunctive relief and indemnity claims, as well as contribution claims for contamination and remediation conducted under CERCLA, RCRA, CWA and state laws.
His client base represents an array of industry sectors ranging from oil and gas producers, developers, manufacturers, and financial institutions in transactions involving current and former commercial and industrial sites in assessing and managing environmental risks and liabilities critical to the structure of the transaction and investment analysis.
In connection with those representations, he routinely negotiates the environmental transactional agreements, regulatory consent agreements, and prospective purchaser agreements. He negotiates technically complex consent decrees with the U.S. Department of Justice, the U.S. Environmental Protection Agency, and state EPAs. He regularly conducts environmental, health and safety compliance audits of manufacturing facilities.
Michael is currently serving as the Chair of the Environmental Law Committee for the Business Law Section of the American Bar Association and Co-Chair of McGlinchey’s Environmental Practice Group.
