ABOUT
Aleks Altshuler helps financial institutions protect their assets, internal processes, and reputations through all types of litigation and non-litigation issues. He represents clients in complex counterclaims brought under the Truth in Lending Act (TILA), the Fair Credit Billing Act (FCBA), the Fair Credit Reporting Act (FCRA), the Fair Debt Collection Practices Act (FDCPA), the Telephone Consumer Protection Act (TCPA), as well as under other federal and state laws and regulations.
In addition to litigating lender liability claims, Aleks also has particular experience in recovering unpaid obligations from debtors that assert claims against lenders. Before joining McGlinchey, he handled litigation involving the collection of corporate, business, and personal debts in New York state and federal courts, and supervised such litigation throughout the country. Aleks also advised the General Counsel’s Office of a major credit card company on regulatory and compliance matters.
His considerable litigation background equips Aleks to counsel clients on adjusting internal processes and procedures to strengthen controls, shrink risk of liability exposure, and avoid regulatory pitfalls. Clients appreciate his holistic approach to their disputes, which begins with a thorough analysis of the root causes and circumstances that led to the issue before identifying practical solutions and opportunities for preventing similar scenarios in the future.
As an advocate, Aleks believes his role requires him to guide clients toward the optimal result. Often, that means resolving claims outside of court, allowing the parties to the dispute to actively shape the outcome rather than leaving the decision to outsiders.
